<br />THE CORPORATION OF THE TOWN OF LAKESHORE <br /> <br />BY -LAW NUMBER 101-2001 <br /> <br />BEING A BY-LAW TO IMPOSE FEES AND CHARGES FOR SERVICES OR ACTIVITIES <br />PROVIDED BY THE ONTARIO PROVINCIAL POLICE, LAKESHORE DETACHMENT ON <br />BEHALF OF THE CORPORATION OF THE TOWN OF LAKESHORE POLICE SERVICES <br />BOARD RELATING TO PRIVATE SECURITY ALARMS <br /> <br />WHEREAS the Ontario Provincial Police, Lakeshore detachment has reported to the Lakeshore <br />Police Services Board, a high incidence of false alarms; <br /> <br />AND WHEREAS concern has been expressed by O.P.P. Administration and the Board that when <br />personnel is commissioned to a false alarm, the officers are jeopardizing their own safety and the general <br />safety of the public; <br /> <br />AND WHEREAS the Ontario Provincial Police, Lakeshore detachment incurs considerable costs <br />in responding to calls for service initiated by alarm systems installed in residential and commercial <br />premises which are ultimately determined to be false alarms; <br /> <br />AND WHEREAS response to false alarms interferes with the ability of the Police Service to <br />respond to actual incidents and draws from the policing compliment to the remainder of the municipality; <br /> <br />AND WHEREAS the Police Services Board of the Town of Lakeshore is desirous of minimizing <br />risk to officer and public safety and ensuring the maximum policing compliment to the municipality at all <br />times; <br /> <br />AND WHEREAS by resolution adopted on September 17th, 2001, the Police Services Board <br />recommended to the Council of the Town of Lakeshore the adoption of a PaIse Alarm By-law as a means to <br />obtaining voluntary compliance from residents towards repairing defective alarm systems and maintaining <br />effective operation of same; <br /> <br />AND WHEREAS the Council of the Corporation of the Town of Lakeshore concurred with the <br />recommendation of the Board at a meeting held on October 23rd, 2001 to adopt a PaIse Alarm By-law. <br /> <br />AND WHEREAS pursuant to the Municipal Act, R.S.O. 1990c.M 45, as amended the Town of <br />Lakeshore is authorized to pass by-laws imposing fees or charges on any class of persons for services or <br />activities provided or done by it or on behalf of it; <br /> <br />AND WHEREAS it is deemed to be expedient to adopt a "PaIse Alarm By-law"; <br /> <br />AND WHEREAS the Ontario Provincial Police, Lakeshore Detachment will register information <br />pertaining to premises equipped with alarms; <br /> <br />NOW THEREFORE the Corporation of the Town of Lakeshore enacts as follows: <br /> <br />1. In this By-law: <br /> <br />"ALARM" is the signal activated for the legitimate purpose of notification of a criminal act, an <br />attempted criminal act, or any bona fide emergency situation. <br /> <br />"AT FAULT FALSE ALARM" will be defined as follows: <br /> <br />I. the testing of an alarm without police knowledge and approval; <br />II. alarms caused by the negligence or carelessness of the alarm company, the alarm monitoring <br />company, the alarm owner, or alarm user; <br />III. alarms activated due to mechanical failure or improper installation; <br />IV. alarms activated by internal or external atmospheric conditions, vibrations or power surges. <br /> <br />A "BONA FIDE" emergency is defined to exist where there is <br /> <br />V. an attempted or completed criminal act, or <br />any other valid emergency situation occurring at, or in relation to the premise. <br /> <br />"REGISTERED PREMISES" means any premises containing an alarm which, is validly registered <br />with the Ontario Provincial Police, Lakeshore Detachment. <br /> <br />"LOW PRIORITY NOTICE" means a notice issued by the Ontario Provincial Police, Lakeshore <br />Detachment after attendance at (3) "at fault false alarms" which identifies that response to an alarm at a <br />specified location will be deemed as a "low priority". <br /> <br />2. The Ontario Provincial Police, Lakeshore Detachment shall maintain a registration system of any <br />alarmed premises which are voluntarily registered by the owner/occupier.
