THE CORPORATION OF THE TOWN OF LAKESHORE <br />BY-LAW 76-2019 <br />Being a By -Law to Amend By -Law 24-2011 <br />being a By -Law to Regulate the Placing or <br />Dumping of Fill, Alteration of the Grade Of, or <br />Removal of Topsoil from Land in the Town Of <br />Lakeshore) <br />Whereas The Corporation of the Town of Lakeshore did enact By-law 24-2011 on the <br />22nd day of February, 2011; <br />And whereas The Corporation of the Town of Lakeshore now deems it expedient to <br />amend certain provisions contained in By-law 24-2011; <br />Now therefore the Council of The Corporation of the Town of Lakeshore enacts as <br />follows: <br />1. Section 1.1 of By-law 24-2011 is amended by adding the following term and <br />definition immediately following the definition of "Building Inspector' and <br />immediately before the term and definition of "Chief Building Official": <br />"By-law Compliance Officer" means the persons designated as such by the <br />Town;". <br />2. Section 1.1 of By-law 24-2011 is amended by replacing the term and definition <br />of "Officer' with the following: <br />"Officer" means Chief Building Official, Building Inspector and By-law <br />Compliance Officer;". <br />3. Section 3 of By-law 24-2011 is deleted and replaced by the following: <br />"The following provisions shall apply to all lands zoned agricultural in a Town <br />of Lakeshore Zoning By-law in addition to the provisions of Section 2. <br />3.1 No person shall dump on, Fill, remove topsoil from or grade lands, or <br />cause or permit dumping on, Filling, removal of topsoil from or the Grading <br />of lands zoned Agricultural in the Town of Lakeshore Zoning By-law without <br />a Permit. <br />3.2 The Chief Building Official may issue a Permit in relation to lands zoned <br />Agricultural in the Town of Lakeshore Zoning By-law where: <br />(a) a building permit has been issued for the construction of a structure <br />on the lands and the dumping on, filling of, removal of topsoil from or <br />grading of the land is incidental and subordinate to the construction of <br />the structure; <br />(b) the dumping on, filling of, removal of topsoil from or grading of the <br />land is an approved farm practice as determined by the Ministry of <br />Agricultural, Food and Rural Affairs or the practice falls within the <br />exemptions contained in Section 142 (6) of the Municipal Act, 2001, <br />S.O. 2001, c.25; or <br />(c) the dumping on, filling of, removal of topsoil from, or grading is taking <br />place to alter an existing irregular or unusual feature on the land such <br />as the filling of a pond or the grading of a raised mound of earth." <br />1 <br />
