<br />CORPORATION OF THE TOWN OF LAKESHORE <br /> <br />BY-LAW NUMBER 66-2005 <br /> <br />A BY-LAW TO AMEND BY-LAW 97-2004 <br />BEING A BY -LAW <br />TO PROVIDE FOR THE REGULATION OF WATER SUPPLY IN THE <br />TOWN OF LAKESHORE. <br /> <br />WHEREAS, By-law Number 97-2004, a by-law to provide for the regulation of <br />water supply in the Town of Lakeshore was duly passed by the Council on the <br />19 day of July, 2004 <br /> <br />AND WHEREAS Council deems it necessary to amend Section 6.12 of by- <br />law 97-2004 to provide a policy that will more effectively, reasonably and fairly <br />address those circumstances that involve plumbing problems that can create <br />a financial hardship for residents of Lakeshore; <br /> <br />NOW THEREFORE, the Council of the Town of Lakeshore enacts as follows: <br /> <br />1. That Section 6.12 of by-law 97-2004 is hereby deleted and replaced <br />with the following: <br /> <br />6.12 All water service extensions to and including the meter, as well as any <br />water pipes beyond the meter on the property, shall be properly protected <br />from frost and any other damage at the expense and risk of the owner of <br />the property being serviced. The owner shall be responsible for the water <br />loss occasioned by a leak in the water service extension and/or private <br />main and the charge for such water loss shall be as determined by the <br />Town in accordance with the applicable rates from time to time, and shall <br />include sewage charges at all times for any customers in the sanitary <br />sewer service area where sewer charges are applicable. <br /> <br />Water and Sewer rates refunds related to plumbing problems and that do <br />not pertain to excessive use shall be considered in accordance with the <br />following policy: <br /> <br />a) If the meter reading for any two (2) month period exceeds ten (10) <br />times the average usage for the prior twelve (12) month period, a <br />rebate may be issued for 50% of the usage over the highest bill in the <br />past twelve months (or lesser period if applicable). <br />b) The owner is required to repair the plumbing problem and provide the <br />Town of Lakeshore with a letter indicating the problem has been <br />repaired. The Town will then take two meter readings, two weeks <br />apart, in order to ensure consumption has returned to normal. <br />c) The sewer rate charges will be processed in the same manner as the <br />water charges <br />d) A refund will be available for any property only once in a calendar year. <br />e) This policy will apply to residential customers only. <br /> <br />All other clauses and provisions of the said By-law Number 97-2004 <br />shall be and remain in full force and effect. <br /> <br />This by-law shall come into force and effect on the day of the final <br />passing thereof. <br />
