CORPORATION OF THE TOWN OF LAKESHORE BY-LAW NUMBER 65-2017 A BY-LAW TO REGULATE THE USE OF OFF- ROAD VEHICLES (ORV) ON HIGHWAYS UNDER THE CARE AND CONTROL OF THE TOWN OF LAKESHORE WHEREAS, Section 191.8 of the Highway Traffic Act, R.S.O. 1990 c. H.8, as amended, provides that the Council of a municipality may pass a by-law permitting the operation of Off -Road Vehicles (ORV) on any highway within the municipality that is under the jurisdiction of the municipality, or on any part or parts of such highway and during specified months or hours; AND WHEREAS, Council of the Town of Lakeshore deems it expedient to permit the operation of off-road vehicles on specified highways under the jurisdiction of the Town of Lakeshore. AND WHEREAS, the said ORV's will be allowed to operate within the specified timeframe of 7:00 a.m. to 10:00 p.m. daily, during the period established as December 1 st to April 30th of each year. NOW THEREFORE, the Municipal Council for the Corporation of the Town of Lakeshore enacts as follows: 1. In this By-law; "All -Terrain Vehicle" has the same meaning as in O.Reg. 316/03, as amended; "HTA" means Highway Traffic Act, R.S.O. 1990 c. H.8, as amended; "Multi-purpose Off -Highway Utility Vehicle" has the same meaning as in O.Reg. 316/03, as amended; "O.Reg. 316/03" means Ontario Regulation 316/03, Operation of Off - Road Vehicles on Highways, as amended; "Permitted Off-road Vehicle" means an All -Terrain Vehicle, Multi - Purpose Off-highway Utility Vehicle or a Recreational Off -Highway Vehicle; "Recreational Off -Highway Vehicle" has the same meaning as in O. Reg. 316/03; 2. Subject to Section 3, Permitted Off -Road Vehicles may be operated only on the portions of those highways under the jurisdiction of the Town of Lakeshore listed in Schedule "A" attached to and forming part of this by- law, between the hours of 7:00 am and 10:00 pm daily from December 1 st until April 30th 3. All provisions of O.Reg. 316/03 and the HTA shall apply to this By-law and the operation of Permitted Off -Road Vehicles within the jurisdiction of the Corporation of the Town of Lakeshore. 4. This by-law shall not be construed as applying to or permitting the use of golf carts or any other vehicle listed in section 2 of the General Regulation under the Off Road Vehicles Act, R.R.O.1990 Reg. 863, as amended. 5. This By-law shall come into full force and effect upon the final passing thereof.
