The Corporation of the Town of Lakeshore <br />By -Law 61-2020 <br />Being a By-law to Licence and Regulate Vehicles for Hire <br />Whereas pursuant to paragraphs 6, 8, and 11 of subsection 11(2) of the Municipal <br />Act, 2001, S.O. 2001, c. 25, a municipality may pass bylaws for the health, safety and <br />well-being of persons, and for the protection of persons and property, including <br />consumer protection, in addition to business licensing; <br />And whereas pursuant to subsection 8(3) of the Municipal Act, 2001, the bylaws of <br />a municipality may regulate or prohibit regarding a certain matter, and may require a <br />person to do certain things or provide for a system of licences respecting that matter; <br />And whereas section 151 of the Municipal Act, 2001 authorizes a municipality to <br />licence, regulate and govern any business carried out wholly or partly within the <br />municipality, and section 11(2) of the Act also authorizes the Town to pass bylaws for the <br />health, safety and well-being of persons and protection of persons and property <br />including consumer protection; <br />And whereas section 156 of the Municipal Act, 2001 provides further authority for <br />the licensing, regulating and governing of the owners and drivers of Taxicabs; <br />And whereas Council has determined that it is appropriate and desirable to <br />licence vehicles for hire, drivers brokers and private transportation companies for the <br />purposes of ensuring the health and safety of both passengers and drivers, for the <br />protection of persons and property and to ensure consumer protection, and to ensure <br />that efficient Vehicle for Hire services are available to all persons within the Town of <br />Lakeshore; <br />Therefore, the Council of The Corporation of the Town of Lakeshore enacts as follows: <br />Part 1 - Definitions <br />1",$pjpqpi".means within 20 days of receipt of notice of the decision being appealed; <br />"Applicant" means a Person applying for a Licence under this by-law; <br />"Broker" means any Person who accepts Requests for Service or Dispatches a Vehicle <br />for Hire; <br />"Brokerage" means the business of a Broker and shall be deemed to include the premises <br />on which the business is conducted; <br />"Cab" means a motor vehicle that is available for or providing a Conveyance Service, but <br />does not include a Limousine, or Private Vehicle for Hire, or a vehicle that is Operating <br />under a Private Transportation Company that is Licenced by the Town; <br />"Cab Meter" means an independent self-contained measuring device approved by the <br />Licence Issuer and used in a Cab to calculate, amongst other things, the rate payable for <br />a Trip; <br />"Conveyance Service" means conveying one or more Persons in exchange for a Fare <br />within the Town or from any point in the Town to any point outside the Town; <br />"Council" means the municipal council of the Town; <br />"Dispatch" means the sending of a Vehicle for Hire to a location for the purpose of offering <br />or providing transportation to a Passenger, and includes but is not limited to: <br />
