The Corporation of the Town of Lakeshore <br />By -Law 60-2020 <br />Being a By -Law to Regulate Site Alterations of Land or <br />Private Drain Alterations in the Town Of Lakeshore <br />Whereas, section 142 of the Municipal Act 2001, S.O., 2001, c. 25, provides local <br />municipalities with the power to prohibit or regulate and issue permits respecting the <br />dumping or place of fill, removal of topsoil or the alteration of the Grade of Land; <br />And whereas, the Council of The Corporation of the Town of Lakeshore considers it <br />desirable to pass such a by-law; <br />Now therefore, the Council of The Corporation of the Town of Lakeshore enacts as <br />follows: <br />Section 1 — Definitions <br />1.1 In this by-law, <br />"Administration Fee" means the fee for the administration of remediation costs <br />pursuant to this by-law and the amount as set out in the User Fee By-law; <br />"Aggregate Resources Act' means the Aggregate Resources Act, R.S.O. 1990, <br />c.A.8; <br />"Appeal Fee" means the fee to file an appeal pursuant to this by-law and the <br />amount as set out in the User Fee By-law; <br />"By-law Compliance Officer" means the persons designated as such by the Town <br />for enforcement of by-laws pursuant to the Provincial Offences Act, and includes <br />the Chief Building Official; <br />"Chief Building Official" means the person designated as such by the Town; <br />"Clerk" means the person appointed by Council as the municipal clerk pursuant <br />to the Municipal Act, 2001; <br />"Crown of the Road" means the highest portion of a road cross-section, generally <br />associated with the centerline of the road; <br />"Drainage Act"means the Drainage Act, R.S.O. 1990, c.D.17; <br />"Dump" or "Dumping" means the deposit or placement of Fill Material from one <br />location to another and includes from one location at a site to another location on a <br />site on the same property; <br />"Electricity Act' means the Electricity Act, 1998, S.O. 1998, c.15, Sched.A; <br />"Fill" or "Filling" means the alteration of the existing grade of the Land through the <br />addition of Fill Material; <br />"Fill Material" means any type of material capable of being removed from or <br />deposited on Land, and may include soil, Topsoil, stone, sod, turf, concrete, asphalt, <br />either singly or in combination; <br />"Grade" or "grading" means the elevation of the ground surface of Land; <br />"Land" means any real property within the geographic boundaries of the Town of <br />Lakeshore; <br />
